Platform Policy

Effective October 27, 2026

This Platform Policy governs access to and use of the AVVA Eats online ordering platform, including this ordering website, the administration dashboard, the menu editor and the application programming interfaces (together, the “Platform”). The Platform is owned and operated by AVVA Marketing (“we,” “us”) and is made available to restaurants and their customers. By using the Platform, including by placing an order, you agree to this Policy, the Terms and Conditions and the Privacy Policy.

1. Ownership

The Platform, including its software, source and object code, databases, designs, layouts, user interfaces, text, graphics, trademarks, logos and documentation, and all updates and improvements, is and remains the exclusive property of AVVA Marketing and its licensors, and is protected by United States and international copyright, trademark, trade secret and other intellectual property laws. No ownership rights are transferred to you. All rights not expressly granted are reserved. Content that belongs to a restaurant, such as its name, logo, menu text and photographs, remains the property of that restaurant or its licensors.

2. Limited license

Subject to this Policy, we grant you a limited, revocable, non-exclusive, non-transferable license to access and use the Platform for its intended purpose: customers to browse menus and place orders, and authorized restaurant staff and administrators to manage their own restaurant’s menus, orders and settings. Any other use requires our prior written consent.

3. Restrictions and reverse engineering

You may not, and may not allow anyone else to:

4. Data, menu data and automated access

Menu data, prices, descriptions, images, hours, delivery areas and other information on or in the Platform, whether created by us or by a restaurant, is protected content. Without our prior written consent you may not use any robot, spider, crawler, scraper, script, bot or other automated or manual process to access, screen-scrape, harvest, copy, export, monitor, index, mirror or otherwise extract such data, and you may not use it for any purpose, including research, price comparison, aggregation, listing on another site or service, training of machine learning or artificial intelligence models, or resale. This does not prevent a restaurant’s authorized administrators from using the Platform’s own export, import or API features for that restaurant’s data in the manner they are provided. Ordinary search-engine indexing that respects our site instructions is permitted.

We may use technical measures to detect and block violations, and may suspend access, without notice, to anyone we believe is violating this section.

5. How we use data

6. Accounts, credentials and API keys

Administrative users and API integrations are issued credentials that are personal to them. You are responsible for keeping credentials, passwords, two-factor codes and API keys confidential, for all activity under them, and for promptly telling us of any suspected unauthorized use. API keys may be used only for the restaurant location they were issued for, may not be shared or published, and are subject to rate limits. We may revoke any credential at any time.

7. Acceptable use

You may not upload or transmit content that is unlawful, infringing, defamatory, deceptive or harmful, or content you do not have the right to use. Restaurants must have the rights to all images and text they upload, and are responsible for complying with food-safety, licensing, tax and alcohol laws that apply to them.

8. Third-party services

The Platform works with third-party services such as payment processors, text and email delivery, mapping and address services, and delivery dispatch. Those services are provided by their own owners under their own terms and privacy policies. We are not responsible for them, and their availability may affect the Platform.

9. Availability and changes

We work to keep the Platform available, but we do not guarantee uninterrupted or error-free operation. We may modify, suspend or discontinue any part of the Platform, and perform maintenance, at any time.

10. Suspension and termination

We may suspend or terminate access to the Platform at any time, with or without notice, if we believe you have violated this Policy or if needed to protect the Platform, its users or the law. Sections that by their nature should survive termination, including ownership, restrictions, data, disclaimers, liability, indemnification and governing law, will survive.

11. Disclaimer of warranties

The Platform is provided “as is” and “as available,” without warranties of any kind, whether express or implied, including implied warranties of merchantability, fitness for a particular purpose, title and non-infringement, to the fullest extent permitted by law.

12. Limitation of liability

To the fullest extent permitted by law, AVVA Marketing and its owners, employees and licensors will not be liable for any indirect, incidental, special, consequential or punitive damages, or for lost profits, revenue, data or goodwill, arising from or related to the Platform, even if advised of the possibility. Our total liability for any claim arising from the Platform will not exceed the greater of the amount you paid us for the Platform in the twelve months before the claim or one hundred U.S. dollars ($100).

13. Indemnification

You agree to defend, indemnify and hold harmless AVVA Marketing, its affiliates, owners and employees from any claim, loss, liability or expense, including reasonable attorneys’ fees, arising from your breach of this Policy, your content or data, or your violation of any law or third-party right.

14. Changes to this Policy

We may update this Platform Policy from time to time by posting the new version on this page and updating the effective date. Continued use of the Platform after a change means you accept it.

15. Governing law and disputes

This Policy is governed by the laws of the State of Georgia, United States, without regard to its conflict-of-laws rules. You agree that the state and federal courts located in Georgia have exclusive jurisdiction over any dispute arising from it or from your use of the Platform. If any provision is held unenforceable, the remaining provisions remain in effect. Our failure to enforce a provision is not a waiver of it.
